Agreement
These Terms of Service (“Terms”) govern your use of muxila.com and any services provided by Muxila, operated by OD “ISLAMOVIC” (“Muxila”, “we”, “us”). If you do not agree, do not use the site or our services.
You must be at least 18 years old. If you act on behalf of a business, you confirm you have authority to bind that business.
What Muxila provides
Muxila provides an internal AI assistant: a private assistant that answers a client’s employees from the client’s own documents, with sources cited and access limited by the permissions the client sets. It is available in a web app, in chat tools such as Slack, and to AI tools over the Model Context Protocol (MCP). We set it up with the client, train the client’s team, and operate it on an ongoing basis.
Muxila is not a web design or custom software agency. We serve companies across industries. Specific deliverables, timelines, and fees for each deployment, including the setup fee and the monthly fee, are defined in a written proposal, scope document, or invoice (an “Order”).
These Terms, the Order, our Privacy Policy, and our Refund Policy together form the agreement. If an Order conflicts with these Terms, the Order governs for that engagement.
Website use
You may use muxila.com for lawful purposes only. You agree not to:
- attempt to access systems or data you are not authorized to use,
- interfere with the site’s security, availability, or performance,
- scrape, copy, or republish site content without permission,
- submit false, misleading, or unlawful information through our forms,
- impersonate any person or misrepresent your affiliation.
Client engagements
When you become a Muxila client, you agree to:
- provide timely access, credentials, content, and approvals needed to deploy and operate your assistant,
- keep integration credentials confidential and notify us promptly if they are compromised,
- use the delivered assistant in compliance with all applicable laws, including consumer protection, advertising, data protection, and any industry-specific regulations relevant to your business,
- publish appropriate privacy notices and obtain required consents for data processed through the assistant,
- review AI-generated responses where they affect employment, legal, financial, health-related, or other sensitive matters.
Payments
Fees, billing cycles, and payment methods are set out in each Order. Unless stated otherwise:
- invoices are due within 7 days of issue,
- fees are exclusive of applicable taxes,
- overdue amounts may incur a late fee of 1.5% per month or the maximum permitted by law,
- we may pause work or access while an invoice is overdue.
Refunds are handled under our Refund Policy.
AI outputs and limitations
Muxila agents use AI models and automation workflows. AI responses can be inaccurate, incomplete, or outdated. You are responsible for:
- configuring guardrails and email-alert rules appropriate to your business,
- maintaining an accurate knowledge base and product/service data,
- keeping human oversight where decisions have legal, financial, or safety implications.
We do not guarantee specific business outcomes such as increased sales, bookings, or revenue. Results depend on your offer, traffic, market, staff handling, and factors outside our control.
Third-party platforms
Our assistant integrates with third-party services (e.g. Google Drive, Microsoft 365, Notion, Slack, AI APIs). Their availability, features, pricing, and terms are controlled by those providers. We are not responsible for outages, API changes, account suspensions, or policy changes by third parties.
Intellectual property
Muxila retains ownership of our platform, frameworks, prompts, templates, and pre-existing materials unless otherwise agreed in writing. Upon full payment, you receive a perpetual, non-exclusive license to use the deliverables configured for your business.
We may reuse generalized know-how, anonymized learnings, and non-client-specific components in future work. The Muxila brand, website, and marketing content remain our property.
You retain ownership of your business data, branding, and content you provide to us.
Confidentiality
Each party will protect the other’s confidential information with reasonable care and use it only to perform under the engagement. This obligation survives for 3 years after the engagement ends.
Warranties and disclaimers
The website and services are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
Limitation of liability
Muxila is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities arising from use of the site or services.
Our total liability for any claim relating to the site or a specific engagement will not exceed the greater of (a) amounts you paid Muxila for that engagement in the 6 months before the event giving rise to the claim, or (b) USD 100.
Indemnification
You agree to defend, indemnify, and hold Muxila and its personnel harmless from claims, losses, and expenses (including reasonable legal fees) arising from your use of the site or deliverables, your business data, your users’ interactions with your assistant, or your violation of these Terms or applicable law.
Term and termination
These Terms apply while you use the site or receive services from us. We may suspend or terminate access for breach, legal risk, suspected fraud, or non-payment. Engagement-specific termination rights are in the Order. Sections that by nature should survive (fees owed, intellectual property, confidentiality, disclaimers, liability limits, indemnification, governing law) survive termination.
Governing law
These Terms are governed by the laws of Bosnia and Herzegovina, without regard to conflict-of-law principles. Courts in Sarajevo, Bosnia and Herzegovina have exclusive jurisdiction, except that either party may seek injunctive relief in any competent court to protect intellectual property or confidential information.
If you are a consumer in the EU, you retain mandatory protections under the law of your country of residence.
Changes
We may update these Terms. We will revise the “Last updated” date and, for material changes, provide reasonable notice. Continued use of the site after changes constitutes acceptance.
